1. Eligibility. This promotion is open to residents of participating countries, United States of America and Canada. The promotion is not open to residents of the United Kingdom or any other unnamed countries. Promotion is valid where legal. Promotion is void anywhere where participation is prohibited, taxed or restricted by law. For United States and Canada, participation open only to legal residents of the 48 contiguous United States and Canada (excluding Quebec), age 21 and over. Employees, officers & directors of VisitScotland, ("Sponsor"), easyJet, DFDS, Arnold Clark, Festivals Edinburgh, The Macallan Distillers Limited, Auld Reekie, Blythswood Square, Braemar Royal Highland Gathering, Ghillie Dhu, Highland Safaris, Meldrum House Country Hotel, Hotel Missoni, Orkney Folk Festival, Stevenson House, Robert Burns Birthplace Museum, The Glasgow School of Art, Mar Hall, The National Piping Centre, Spring Fling, Edinburgh's Festivals, Edinburgh Pass, 21st Century Kilts and their parent companies, subsidiaries, affiliates, partners, dealers, advertising and promotion agencies, manufacturers or distributors of sweepstakes materials and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees/officers/directors are not eligible to enter. The minimum age of entry is 21 years old.
2. How to Enter. Log onto www.visitscotland.com/de, www.visitscotland.com/fr, www.visitscotland.com/es, www.visitscotland.com/it, www.visitscotland.com/be, www.visitscotland.com/se, or www.visitscotland.com/nl and follow the directions to enter between 9h00 (GMT) from February 6th 2012 and 17h00 (GMT) on December 14th 2012. All entrants must have a valid email address. In case of dispute as to identity of entrant, entry will be declared made by the authorized account holder of the email address submitted at time of entry. "Authorized Account Holder" is defined as the natural person who is assigned an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning email addresses or the domain associated with the submitted email address.
The potential winner will be required to provide the Sponsor with proof that such winner is the authorized account holder of the email address associated with the winning entry. Any other attempted form of entry is prohibited; no automatic, programmed; robotic or similar means of entry are permitted. The Sponsor, its affiliates, partners, agencies and any entities involved with the administration or fulfillment of this Sweepstakes are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, Web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one's ability to enter the Sweepstakes, including any injury or damage to participant's or any other person's computer relating to or resulting from participating in this Sweepstakes or downloading any materials in this Sweepstakes.
Limit one (1) entry per person. All entries become the sole property of the Sponsor and receipt of entries will not be acknowledged or returned. The Sponsor is not responsible for lost, late, illegible, incomplete, invalid, unintelligible, technically corrupted or misdirected entries, which will be disqualified. Only fully completed entry forms are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor.
3. Drawing. The winner will be drawn at random under independent supervision and notified by email by Friday 13th January 2013 for the receipt of entry. The decision of the Sponsor will be final in respect of all matters to do with the promotion.
4. Prizes. One (1) Grand Prize: A trip for four (4) people to Scotland, consisting of:
Each of the following prize options also includes two (2) nights of accommodation, not necessarily consecutively, at either the Missoni Hotel in Edinburgh or the Blythswood Hotel in Glasgow - the selection of which is at the discretion of the competition provider.

All travel and accommodations are at the winner’s and travel companion’s risks. Transportation to and from departure airport, taxes, meals, gratuities, travel upgrades, or any other expenses not specifically listed herein responsibility of winner. Travel and accommodations subject to availability; certain restrictions and blackout dates may apply. Winner and travel companions must travel on the same itinerary. Travel companions must be of the age of majority in their jurisdiction of residence unless winner is travel companion’s parent or legal guardian. Sponsor is not liable for delays, cancellation or unforeseen events related to the flights. Winner and travel companions will be solely responsible for obtaining valid identification relating to acceptance and use of the travel prize packages and must have no impediment to entering Scotland. Winner and travel companions will have to comply with Arnold Clark terms and conditions of hire in order to receive car hire prize element (i.e. valid driver’s licence). Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates.
The winner must choose three (3) additional travelers, for a total group of four (4) people. The prize must be taken on dates in 2013 to coincide with the events specified. Dates will be confirmed on notification to winner and unless otherwise agreed by the Sponsor it is available only to that winner and chosen companions. In the event the winner cannot be contacted, does not respond within seven (7) days, or cannot take the prize at this time the Sponsor will withdraw prize entitlement and award it to a substitute drawn at the same time as the original.
5. Notification. Winners will be notified by email Friday 13th January 2013 and may be required to sign and return, where legal, an Affidavit of Eligibility and Liability/Publicity Release within seven (7) days of prize notification. Travel companions may also be required to sign and return a Liability/Publicity Release, prior to issuance of prize elements. If winner cannot be contacted, if the prize is returned as undeliverable, or in the event of noncompliance with these Sweepstakes rules and requirements, the prize will be forfeited and an alternate winner will be selected. Upon prize forfeiture, no compensation will be given.
6. Conditions. Participation in Sweepstakes and acceptance of prize constitutes winner's permission for Sponsor to use his/her name, address (city and state), likeness, biographical information and any statements made by winner regarding the Sweepstakes or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law. By participating, entrants, winner and travel companions agree to release and hold harmless VisitScotland, ("Sponsor"),easyJet, DFDS, Arnold Clark, Festivals Edinburgh, The Macallan Distillers Limited, Auld Reekie, Blythswood Square, Braemar Royal Highland Gathering, Ghillie Dhu, Highland Safaris, Meldrum House Country Hotel, Hotel Missoni, Orkney Folk Festival, Stevenson House, Robert Burns Birthplace Museum, The Glasgow School of Art, Mar Hall, The National Piping Centre, Spring Fling, Edinburgh's Festivals, Edinburgh Pass, 21st Century Kilts and their respective advertising and promotion agencies, and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Sweepstakes, or possession, acceptance and/or use or misuse of prize or participation in any Sweepstakes-related activity and claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Sponsor is not responsible if any prize cannot be awarded due to travel cancellations, delays or interruptions due to Acts of God, Acts of War, natural disasters, weather or terrorism. Entrants who do not comply with these Official Rules, or attempt to interfere with this Sweepstakes in any way shall be disqualified. Prizes are non-transferable. No substitutions or cash redemptions. In the case of unavailability of any prize, Sponsor reserves the right to substitute a prize of equal or greater value. There is no purchase or sales presentation required to participate. The prize is not transferable in any way and must be taken by the designated winner and his/her chosen travel companions. The winner and travel companions are responsible for their own travel insurances, valid passports, and driver's license(s) and also may be responsible for any additional taxes.
7. Additional Terms. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend this Sweepstakes should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor will select the winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, to be tampering with the entry process or the operation of the Sweepstakes or Web site.
7.1 To the fullest extent allowed by law the Sponsor accepts no responsibility for loss or injury resulting from the acceptance of the prize.
7.2 The laws applicable to promotions in Scotland will apply.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
8. Use of Data. Sponsor will be collecting personal data about participants when they enter the Sweepstakes online, in accordance with its privacy policy. Marketing information will be sent only to entrants who have "opted-in" to receive further information from VisitScotland and its affiliates. By participating in the Sweepstakes, entrants hereby agree to Sponsor's collection and usage of their personal information and acknowledge that they have read and accepted Sponsor's privacy policy. Data will be handled under UK law.
9. Winners List. To obtain name and details of Grand Prize winner, send a self-addressed, envelope to: Year of Creative Scotland competition, c/o International Marketing, VisitScotland, Ocean Point One, 94 Ocean Drive, Edinburgh, Scotland, UK EH6 6JH.
