1. How to Enter. Log onto www.cometoscotland.com/win or www.cometoscotland.ca/win (collectively referred to herein as "Web site") and follow the directions to enter between 12:00:01 PM Eastern Time ("ET") on January 27, 2010 and 11:59:59 PM ET on May 17, 2010 ("Sweepstakes Period"). You must include on the entry form your complete name, email address, and zip code/postal code. All entrants must have a valid email address. In case of dispute as to identity of entrant, entry will be declared made by the authorized account holder of the email address submitted at time of entry. "Authorized Account Holder" is defined as the natural person who is assigned an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning email addresses or the domain associated with the submitted email address. The potential winner may be required to provide Sponsor (defined below) with proof that such winner is the authorized account holder of the email address associated with the winning entry.
Any other attempted form of entry is prohibited; no automatic, programmed, robotic or similar means of entry are permitted. Sponsor, its affiliates, partners, agencies and any entities involved with the administration or fulfillment of this Sweepstakes are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, Web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one's ability to enter the Sweepstakes, including any injury or damage to participant's or any other person's computer relating to or resulting from participating in this Sweepstakes or downloading any materials in this Sweepstakes.
Limit one (1) entry per person/email address. The Web site will allow you to forward the Sweepstakes to your friends. All entries become the sole property of the Sponsor and receipt of entries will not be acknowledged or returned. Sponsor is not responsible for lost, late, illegible, incomplete, invalid, unintelligible, technically corrupted or misdirected entries, which will be disqualified. Only fully completed entry forms are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor.
2. Eligibility. Participation open only to legal residents of the 48 contiguous United States and Canada (excluding Quebec), age 21 and over. Void in Alaska, Hawaii, Puerto Rico, Quebec, anywhere outside of the U.S. and Canada, and where prohibited, taxed or restricted by law. Employees, officers and directors of VisitScotland ("Sponsor"), Continental Airlines, Canadian Affair, CIE, Festivals Edinburgh, Sheraton Grand Hotel & One Spa, and their parent companies, subsidiaries, affiliates, partners, dealers, advertising and promotion agencies, manufacturers or distributors of sweepstakes materials and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees/officers/directors are not eligible to enter. Sweepstakes is governed exclusively by the laws of the United States and Canada, may only be entered in or from the 48 contiguous United States and Canada, and entries originating from any other jurisdiction are not eligible for entry.
3. Drawing. The winner will be selected in a random drawing from all eligible entries received. Odds of winning depend on the number of eligible entries received for the drawing. Drawing will be conducted by Aptinet, an independent judging organization, on or about May 19, 2010. By entering the Sweepstakes, entrants fully and unconditionally agree to be bound by these rules and the decisions of the judges, which will be final and binding in all matters relating to the Sweepstakes.
4. Prizes. One (1) Grand Prize winner ("winner") will receive the Grand Prize which includes: A trip for two (2) to Edinburgh, Scotland, consisting of: round-trip coach-class airfare on Continental Airlines (from the U.S.) or Canadian Affair (from Canada)from international airport nearest winner’s home, 4-night accommodations (double occupancy) at the Sheraton Grand Hotel & Spa in Edinburgh on a Bed and Breakfast basis, and two (2) VIP festival passes for the festival chosen by winner at time of entry("Chosen Festival Theme") (as set forth below). Winner can bring one (1) travel companion, for a total group of two (2) people. Winner and travel companion must be willing to travel the week of August 8th, 2010 or August 15th, 2010 (specific dates of travel will be determined based on the dates of Winner’s Chosen Festival Theme), or prize will be forfeited and awarded to an alternate winner in a random drawing from all remaining eligible entries. Relevant date for winner to arrive in Scotland will be determined based on winner’s Chosen Festival Theme. Winner may select one of the following Chosen Festival Themes: (i) Jazz Theme; (ii) Art Theme; (iii) Fringe Theme; (iv) Tattoo Theme; (v) Book Theme or (vi) International Theme. Approximate retail value of Prize: $4,500 US, $4725 (CA) but actual value may vary depending on air flight fluctuations and distance between departure and destination. Winner will not receive difference between actual and approximate retail value.
All travel and accommodations are at the winner’s and travel companion’s risks. Transportation to and from departure airport, taxes, meals, gratuities, travel upgrades, or any other expenses not specifically listed herein responsibility of winner. Travel and accommodations subject to availability; certain restrictions and blackout dates may apply. Winner and travel companion must travel on the same itinerary. Travel companion must be of the age of majority in their jurisdiction of residence unless winner is travel companion’s parent or legal guardian. Sponsor is not liable for delays, cancellation or unforeseen events related to the flights. Winner and travel companion will be solely responsible for obtaining valid identification (i.e., passports) relating to acceptance and use of the travel prize packages and must have no impediment to entering Scotland. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates.
5. Notification. Selected entrant will be notified by email and will be required to sign and return, where legal, an Affidavit (Declaration in Canada) of Eligibility and Liability/Publicity Release within seven (7) days of prize notification. Travel companion will also be required to sign and return a Liability/Publicity Release, prior to issuance of prize elements. If selected entrant is a Canadian resident, he/she must correctly answer, unaided, a time-limited mathematical skill-testing question in order to win the prize. If winner cannot be contacted within 7 calendar days of first notification attempt, if any prize is returned as undeliverable, or in the event of noncompliance with these Sweepstakes rules and requirements, the prize will be forfeited and an alternate winner will be selected. Upon prize forfeiture, no compensation will be given.
6. Conditions. Any and all income taxes are the sole responsibility of the winner. Participation in Sweepstakes and acceptance of prize constitutes winner's permission for Sponsor to use his/her name, address (city and state/province/territory), likeness, biographical information and any statements made by winner regarding the Sweepstakes or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law. By participating, entrants, winner and travel companion agree to release and hold harmless VisitScotland, Continental Airlines, Canadian Affair, CIE, Festivals Edinburgh, Sheraton Grand Hotel & One Spa, and their respective advertising and promotion agencies, and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Sweepstakes, or possession, acceptance and/or use or misuse of prize or participation in any Sweepstakes-related activity and claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Sponsor is not responsible if any portion of the prize cannot be awarded due to travel cancellations, delays or interruptions due to Acts of God, Acts of War, natural disasters, weather or terrorism.
Entrants who do not comply with these Official Rules, or attempt to interfere with this Sweepstakes in any way shall be disqualified. Prize is non-transferable. No substitutions or cash redemptions. In the case of unavailability of any portion of the prize, Sponsor reserves the right to substitute a prize of equal or greater value. There is no purchase or sales presentation required to participate. A purchase does not increase odds of winning. The prize is not transferable in any way (except by Sponsor) and must be taken by the designated winner and his/her chosen travel companion. The winner and travel companion are responsible for their own travel insurances, and valid passports.
7. Additional Terms. Sponsor reserves the right to cancel, terminate, modify, or suspend this Sweepstakes should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor may select the winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or Web site.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
8. Use of Data. Sponsor will be collecting personal data about participants when they enter the Sweepstakes online, in accordance with its privacy policy. Marketing information will be sent only to entrants who have "opted-in" to receive further information from VisitScotland and its affiliates. Please review the Sponsor's privacy policy at www.visitscotland.com/sitewide/privacypolicy. By participating in the Sweepstakes, entrants hereby agree to Sponsor's collection and usage of their personal information and acknowledge that they have read and accepted Sponsor's privacy policy.
9. Winner Information. To obtain the name and country of residence of the winner, send a self-addressed, stamped envelope by June 30, 2010 to: Win a Scottish Festival Sweepstakes, c/o Green Team Advertising: 286 Fifth Avenue, 12th Floor, New York, NY 10001. Canadian residents may omit return postage.
